YOUR RIGHTS AND PROTECTIONS
The No Negative Equity Guarantee and Your Obligations
01
No Negative Equity Guarantee
If your loan balance at sale exceeds the property's sale price, the lender absorbs the shortfall. Your estate cannot be pursued for any amount beyond the net sale proceeds. This protection applies to the property sale only, not other assets in your estate.
02
Your Legal Rights
Your rights include remaining in your home, NNEG protection, making voluntary repayments at any time, and receiving independent legal advice before signing.
03
Property Maintenance
You are required to maintain the property in reasonable condition and keep rates and council charges up to date for the life of the loan.
04
Insurance and Occupancy
You must maintain adequate home and contents insurance and notify the lender of any change in occupancy, including moving into aged care.
05
Defaulting on Obligations
Defaulting on these obligations can give the lender the right to enforce the loan. The guarantee is meaningful, but it does not prevent equity erosion during the loan term.

Interest Rate and Access
Private reverse mortgages carry indicative rates of 8.5 to 9 percent per annum or higher, with access via lump sum, income stream, line of credit, or combination. HEAS offers a lower rate of 3.95 percent per annum, with fortnightly income payments or lump sum advances.
Eligibility
Private reverse mortgages require a minimum age of typically 60 and the property must be your primary residence. HEAS requires Age Pension age of 67 and includes self-funded retirees.
Maximum Amount and NNEG Protection
Private reverse mortgages allow roughly 15 to 35 percent of property value depending on age. HEAS allows up to 150 percent of the maximum pension rate as a fortnightly payment. Both include No Negative Equity Guarantee protection.
Who Administers Each
Private reverse mortgages are managed by private lenders and regulated under the National Consumer Credit Protection Act. HEAS is administered by Services Australia on behalf of the Australian Government.
IMPORTANT CONSIDERATIONS
Important Considerations Before Proceeding
01
Impact on Aged Care Costs
How and when you access funds can affect your assets assessment under Centrelink's means test and your aged care means-tested fee. Specialist financial advice is essential before proceeding.
02
Impact on Age Pension
Lump sums may be assessed as an asset or income by Centrelink depending on how they are held and used, which can affect your pension entitlements.
03
Estate Implications
Reduced home equity means less left for beneficiaries. Involving family early and being transparent about the loan can avoid conflict or surprise down the track.
04
Independent Advice Requirements
Most lenders require independent legal advice before signing, and some also require independent financial advice. This is a consumer protection measure, not a formality.
